Trump Seeks $100M Bond in NY Fraud Case

Trump’s lawyers contended that it would be “unattainable” for him to post the full bond without divesting certain properties.

Trump’s legal team seeks to postpone enforcing the $464 million judgment against him, his sons, and his company. They aim to post a $100 million bond instead of the full amount mandated by law.

In a Wednesday filing to the state Appellate Division, Trump’s lawyers claimed it’s “impossible” for him to post the full bond due to restrictions in Judge Engoron’s ruling. They intend to post a $100 million bond, citing the judgment’s severity and restrictions on lending transactions.

Trump’s lawyers argue that without a stay and a reduced bond, selling properties might be necessary for capital, with no means to recover losses if the appeal succeeds. James’ office opposes, stating Trump’s partial bond offer is insufficient and poses risks of evasion or complications post-appeal.

Both sides presented their arguments before Justice Anil C. Singh, with a ruling expected by the end of the day Wednesday.

The $464 million judgment, issued last week, gave Trump 30 days to post a bond, halting James’s office from collecting. It covers prejudgment interest on Engoron’s award, reflecting Trump’s habit of inflating assets for loans. Interest accrues daily until payment or appeal resolution.

Trump’s attorneys argue that the judgment should have been closer to $100 million, citing errors and statute of limitations issues. However, James’ office asserts that these arguments have already been dismissed by the judge and are unlikely to succeed on appeal.

Last week, Trump filed a notice of appeal, seeking a review of Engoron’s ruling, which they described as “staggering.”
